6. Confidentiality

Each party agrees to maintain the confidentiality of any proprietary or confidential information disclosed by the other party in connection with the services. Confidential information shall not be disclosed to third parties without the disclosing partys prior written consent, except as required by law.

This confidentiality obligation shall survive the termination or expiration of any service agreement.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• KJH MEDIA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Website or services.
• Our total liability for any claim arising under these Terms or from the provision of services shall not exceed the total fees paid by the client for the specific service giving rise to the claim.
• We do not warrant that the Website will be error-free, uninterrupted, or free from viruses or other harmful components.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

8. Indemnification

11. Governing Law

Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Hartford County, Connecticut.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the services provided by KJH MEDIA LLC shall first be resolved through good-faith negotiations between the parties. If the dispute cannot be resolved within 30 days of written notice, the parties agree to submit the dispute to binding mediation before a mutually agreed mediator in Hartford County, Connecticut. If mediation is unsuccessful, either party may pursue legal remedies as provided under applicable law.

13. Force Majeure

Neither party shall be liable for any failure or delay in performing obligations under these Terms (except for payment obligations) if such failure or delay is caused by circumstances beyond the partys reasonable control, including but not limited to acts of God, war, terrorism, pandemics, government actions, natural disasters, or failure of telecommunications infrastructure.

14. Entire Agreement

These Terms, together with any applicable service agreement and Privacy Policy, constitute the entire agreement between you and KJH MEDIA LLC regarding the use of the Website and services, superseding any prior agreements or understandings.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

16. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of that term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of that right or provision.
